Copyright Infringement Penalties and Rights Explanation

According to Article 10 of the Copyright Act, copyright protection is granted automatically upon the completion or publication of a work, without the need for registration. Based on the principle of creative protectionism, copyright arises when the identity of the creator, the completion time of the work, and proof of independent creation without plagiarism can be demonstrated.

  1. Civil Liability: Under Article 88 of the Copyright Act, the aggrieved party may request the court to determine compensation ranging from NT$10,000 to NT$1,000,000, depending on the severity of the infringement. If the infringement is intentional and significant, compensation of up to NT$5,000,000 may be sought.

  2. Criminal Liability: Under the Copyright Act, infringement of reproduction rights, adaptation rights, and public transmission rights may result in imprisonment of up to three years, detention, or a fine of up to NT$750,000.
